Introduction
Welcome to Weylandts Furniture Cape Town (Pty) Ltd ("Weylandts"), a lead retailer of furniture and homeware. Our company is registered in South Africa with the Registration Number: 1998/021611/07. The head office is located at 22 Bella Rosa Street, Durbanville, Cape Town, South Africa.
These Terms and Conditions are designed to govern all transactions made with Weylandts, including sales and supplies of products both in-store and through our online platform, accessible at weylandts.co.za (the "Site"). By placing an order, providing delivery instructions, or accepting delivery of any products from Weylandts, you agree to these Terms and Conditions without reservation. It is important to note, however, that these Terms and Conditions do not in any way undermine or replace your statutory rights under applicable law.
1. Definitions
- CPA: Consumer Protection Act, 2008 (Act No. 68 of 2008)
- Customer: Any person who has entered into a transaction with Weylandts in the ordinary course of Weylandts’ business
- Direct marketing: Approach a person, either in person or by electronic communication, for the direct or indirect purpose of promoting or offering to supply goods or services to that person
- Display: Placing, exhibiting, or exposing goods in public view and inviting members of the public to inspect and select those or similar goods for supply to that person
- EFT: Electronic Fund Transaction or direct deposit as a means of electronic payment
- Electronic communication: Communication by means of telephone, SMS, email or similar technology or device
- Juristic person: A company, body corporate, partnership or association, or trust as defined in the Trust Property Control Act, 1988 (Act No. 57 of 1988)
- Price: The value of consideration for which Weylandts is willing to sell or supply goods and services
- Promote: To advertise, display or offer to supply any goods or services
- Special order goods: Goods which Weylandts expressly or implicitly was required or expected to procure, create or alter specifically to satisfy the customer’s requirements
- Transaction: An agreement between Weylandts and a customer for the supply or potential supply of any goods or services in exchange for consideration, or the supply of any goods to or at the direction of a customer for consideration, or the performance by or at the direction of Weylandts of any services for or at the direction of a customer for consideration

- VAT: Value Added Tax, which is an indirect tax levied on the price of consumer goods and services
2. Applicability of the Terms and Conditions
- These Terms and Conditions apply when you use our website to buy goods or services from Weylandts or order/purchase any goods or services at one of our stores. They must be read with the Privacy Policy and Delivery and Collection Handbook as well the terms of our Loyalty Programme, and any other policies or terms which are displayed on our website and the terms and conditions that are incorporated into these terms by reference.
- By purchasing or submitting an order to Weylandts for the supply of goods or services, you acknowledge that you have read and understood these Terms and Conditions and agree to be bound by them. If you do not agree, please do not access our website or place an order with Weylandts for the supply of goods or services.
- All purchases made via our website are subject to availability and acceptance by Weylandts. We reserve the right to reject any order, cancel any purchase whether in whole or in part or refuse to process payment.
- For in-store purchases, you will receive an invoice once your order is shipped. No order will be deemed to be accepted by Weylandts unless and until payment is received by Weylandts.
3. The Goods
- Selected products are advertised on the Weylandts website (www.weylandts.co.za ). Most of these products are displayed and available in Weylandts stores. Details of all our stores appear on the Weylandts website. The availability of any of the products can be confirmed with your preferred Weylandts store.
- While every effort is made to ensure that the product you buy, including timber, fabric and leather products, corresponds as closely as possible to the sample shown in our stores or on our website, slight differences may occur. No responsibility can be accepted for variations which add to the unique characteristics of Weylandts products.

4. Price and Method of Payment
- The prices displayed on the Weylandts website and in stores are quoted in South African Rands, which is valid and effective only in relation to supply in South Africa. All prices displayed in-store or on the Weylandts website are inclusive of VAT.
- Full payment of the price and delivery charges (where applicable) is required before products will be delivered or collected. The product remains the property of Weylandts until payment is received in full.
- All major credit and debit cards as well as EFT payments are accepted.
- Weylandts does not accept cash in store.
- In the case of EFT payments, proof of payment must be forwarded to the relevant store. Please allow 3 business days for the receipt of EFT funds to be confirmed. Goods will only be released for collection or delivery once the receipt of funds has been confirmed.
- When making an EFT payment, Weylandts advises customers to be vigilant and confirm all relevant and necessary information before making payment. Should the payment be intercepted by fraudulent third parties, Weylandts shall not be liable for any loss suffered by the customer. Please be advised that Weylandts will not proceed with the contract of sale if we cannot confirm receipt of funds as a result of fraudulent interception.
- Please retain your invoice as proof of purchase.
- Prices on the website and in-store are subject to change without notification.
5. Special Order Goods
- Lead time for special orders depends on the goods, their availability and performance by Weylandts’ suppliers or manufacturers. The anticipated lead time will be stated on the sales order. Weylandts will inform you of any delays. It is acknowledged that goods that are subject to special orders may differ from samples due to hand made processes and also the considerations set out in THE GOODS section above and it will be so accepted by the customer.
- You will be provided with a quotation for all made to order items and back orders (collectively “special orders”). It is your responsibility to verify the correctness of all information on the quotation before you pay any amount to Weylandts.
- Weylandts will not be responsible for any incorrect orders placed.
- For all special orders, a deposit of seventy percent (70%) is required in advance.
- In the event that the customer cancels a special order, Weylandts is entitled to impose a charge for cancellation of the order, which charge will be dependent on the nature of the goods or services that were ordered or booked and the length of notice of cancellation provided by the customer.
6. Deliveries and Collections
- Weylandts is entitled to charge a delivery fee for any and all transportation of goods at the direction of the customer, including cancelled deliveries that have already been dispatched . You will be charged for the cost of delivery which will be reflected on the appropriate invoice.
- The customer may elect to collect goods at either a distribution centre or their nearest Weylandts store, product and store dependent.
- The customer must inspect all goods delivered , acceptance of the delivered goods by the customer will be considered as satisfaction as to the type and quality of the goods.
- All risk in the goods shall pass to the customer upon delivery or collection thereof. Should you collect the goods, Weylandts will not be held liable for any loss or damage to the goods, whether you, your representative or a third-party transporter collected the goods. For this reason, customers are required to inspect products prior to leaving our premises.
- The details of the delivery, including the particulars of the delivery agent/s, date and place of delivery will be provided to the customer.

- Weylandts will consider requests for international delivery on a case by case basis, please refer to our EXPORTS page on our website for further information on international shipping.
Year-end Delivery Terms
All orders received on or before the dates noted below, will be delivered in 2024.
8 December 2024 - orders being delivered by Weylandts trucks or DC collections (excluding Cape Town DC).
13 December 2024 - Click & Collect orders.
18 December 2024 - standard courier deliveries.
18 December 2024 - orders being collected at the Cape Town DC. The DC closes on 19 December.
All orders received after the dates noted above, will only be scheduled for delivery from 8 January 2025 onwards.
7. Product Assembly
- Weylandts offers free assembly of products bought from Weylandts when products are delivered by Weylandts’ delivery service.
- Product assembly by customers is not recommended. Should you opt to assemble products, kindly refer to assembly instructions included with the product. Weylandts does not accept responsibility for items damaged due to incorrect assembly by a customer. Such items will not be considered for returns or refunds.
8. Conditions of Displayed Products
- If the subject matter of the sale is the particular product that is on display in the Weylandts showroom as viewed by you, the customer, then the product is sold to you in the specific condition in which it is, based on your acceptance of the relevant product in that condition.
9. Care Instructions And Maintainance

- Care instructions and maintenance advice regarding the use and application of products are provided for all products.
- Such instructions are available on the Weylandts website and from in-store sales consultants.
10. Warranty
- Weylandts warranty provides for the free repair or replacement of any faulty component within the first 6 months of the warranty period. Refunds can be claimed as an EFT refund or credit on the customer’s Weylandts account.
- Weylandts offers a one (1) year warranty against defects in workmanship on all goods supplied by it calculated from the date of collection or delivery of the goods to you, provided:
- You are able to produce proof of purchase by way of the original invoice provided to you upon conclusion of the transaction
- The goods concerned have been used for the purpose intended and in a domestic environment (unless the latter requirement is waived by Weylandts, in writing);
- The customer has cared for the goods in line with the Care Instructions displayed on our website and/or available from a Weylandts consultant;
- The goods have not been damaged as a result of misuse, neglect, abuse, or unauthorised modifications by the customer
- The goods were assembled by Weylandts, or according to the instructions provided by Weylandts;
- The goods have not been altered in any manner or partially disassembled by the customer;
- Provided the above mentioned conditions are fulfilled, Weylandts will assess the good/s to confirm such compliance and thereafter repair, where possible, or replace the goods which are subject to the warranty claim.
- If the goods cannot be repaired and are no longer available for supply, Weylandts will credit the customer’s account to the value of the original transaction.
- Please note that in the event that the goods do not meet the requirements mentioned hereinabove the customer will be required to tender payment for the assessment of the goods as well as any delivery costs incurred by Weylandts in order to process the customer’s warranty claim.
- In any event the direct cost of transporting any goods by Weylandts must be paid for by the customer before any transporting arrangements will be made.
- It is entirely at Weylandts’ discretion to offer the necessary remedy, being either repair, replace or store credit, should your product breach the extended warranty. In addition, Weylandts will charge necessary collection and delivery costs in certain circumstances.
- Section 44 of the Electronic Communications and Transactions Act may apply to your electronic transactions. If your transaction qualifies as an electronic transaction and you qualify as a consumer under the ECT Act, you may be entitled to cancel some electronic transactions within seven days, without reason or penalty. This means that you have to return new, unused goods, and we will refund the purchase price. The only cost levied against you will be the direct cost of returning the goods.
11. Returns
Goods cannot be returned to Weylandts if:
- After having been supplied to, or at the direction of, a customer, the goods have been partially or entirely disassembled, physically altered, permanently installed, affixed, attached, joined or added to, blended or combined with, or embedded within other goods or property;
- The original invoice cannot be produced by the customer;
- The goods have been damaged by the customer whilst in its care;
- The original packaging has been removed and the goods are no longer in its original condition;
- The goods are not in resale condition.
Weylandts will accept the return of goods in the following circumstances:
- The original invoice is produced by the customer;
- The return has been submitted by the customer via our website;
- The goods are returned in their original packaging;
- repackaged goods will be accepted by Weylandts if they are in their original condition and only when it was necessary for the customer to remove such packaging in order to inspect conformity of the goods with a special order;
- If goods that were delivered to the customer are incorrect, the customer must submit a request for a return of only those goods that do not conform to the order via our website;
- The customer purchased goods or services via our website, then in that event the customer may cancel such transaction within seven (7) days of receipt of those goods, or of services within seven (7) days after the date of the conclusion of the agreement, and may receive a full refund, however Weylandts will charge the customer for collection and transporting any goods to Weylandts;
- The goods or services were purchased as a result of direct marketing by Weylandts to the customer, then in that event the customer may cancel such transaction by notice to Weylandts in writing via our website, within five (5) business days after the transaction or agreement was concluded or the goods which were the subject of the transaction were delivered to. The customer may receive a full refund, provided you can establish that the transaction was as a result of direct marketing; and
- The goods are defective or unsafe, and such defect or fault was present at the time of the conclusion of transaction and was discovered by the customer within the warranty period, then in that event the customer must submit photographs and a description of the defect together with your request for a return via our website, whereafter the goods will be assessed by Weylandts and a return processed according to the terms referred to in the WARRANTY section above.
- Wherever possible Weylandts will repair or replace returned goods, and where not possible Weylandts will credit a customer’s account with store credit.
- In the event that Weylandts and the customer exchange or substitute any goods previously delivered to the customer, from the date of delivery of the substituted goods, the transaction applies to the substituted goods rather than the goods described in the original transaction.
Weylandts is entitled to charge the customer a reasonable amount for:
- Use of the goods during the time the goods were in the customer’s possession, unless they are goods which are ordinarily consumed or depleted by use and no such consumption or depletion has occurred; or
- For the necessary restoration costs to render the goods fit for restocking.
FURNITURE RETURNS
- In the event of an item being returned due to “Change of Mind” this shall be accepted if the item is physically still at the Cape Town Distribution Centre (CPT DC). No handling fee shall apply in relation to CPT DC. If the item is at one of the Regional Distribution Centres (JHB DC/KZN DC/Nelspruit DC or Knysna DC) a “Change of Mind” will be accepted with a handling fee levied for the transport and return of the product to the Cape Town Distribution Centre. Handling fees shall apply at 20% of the value of the product from the regional DC. “Change of Mind” where the product is at the location specified by the customer for delivery shall not be accepted.) If the product requires upliftment, a collection fee will in addition be charged. The customer will be given a store credit for the value of the furniture product less the handling fee.
- In addition to a product being returnable in terms of the Returns Policy below, if the customer is not happy with their furniture purchase or has made an error with their furniture purchase and wishes to exchange or return their furniture purchase, the customer may do so within 10 business days of purchase. Goods must be returned in their original condition and packaging along with the original invoice.
- If the customer has chosen an exchange, they may not choose a product that exceeds the purchase price of the original product less the handling fee, collection fee and use charge if applicable, unless the customer pays in the difference in the purchase price.
- Before store credit or exchange is processed, the product will be assessed for wear and tear. Should there be evidence of use, we will impose a charge for use. This charge will be in line with the extent of use.
- This section does not apply to custom or made to order products.
- It is acknowledged that exchanges are subject to product availability at the time of the request for exchange.
- Physically altered, partially disassembled or damaged product may not be returned or exchanged in terms of this section. Weylandts will check the condition of products presented for exchange or returned accordingly.
HOMEWARE RETURNS
- Return and exchange of homeware products in line with this section must be done so in-store at your nearest retail store.
- For public health reasons, we cannot accept the return or exchange of linen or bathroom goods.
- No returns or exchanges on light bulbs
- It is acknowledged that exchanges are subject to homeware product availability at the time of the request for exchange.
- Physically altered, partially disassembled or damaged products may not be returned or exchanged. Weylandts will check the condition of products presented for exchange or returned accordingly
- Returns will only be considered within 10 business days from purchase
- Should the return be accepted, the credit amount will remain as an instore credit
- Refunds are not offered for change of mind purchases.
12. Voucher Validity
- Gift vouchers are valid for 12 months.
- Vouchers can only be redeemed in-store.
- Vouchers are not refundable.
- Unfortunately, lost vouchers cannot be replaced.
- We reserve the right, in our sole discretion, to stop issuing vouchers at any stage, without notice.
- If a winner of a gift voucher prize giveaway does not respond to their announcement within 7 days, the prize will be awarded to another lucky draw winner.
13. Discounts, Promotions And Sales
- All discount offers exclude “Promo” or “Sale” items, unless otherwise specified. Pricing can be confirmed at a Weylandts store. All special offers are subject to stock being available.
- Prices may vary between those displayed in store and on our website, particularly during a promotion or sale.
- No director, member, partner, employee, agent of, or consultant to Weylandts or any other person who directly or indirectly controls or is controlled by Weylandts, their spouses, life partners, parents, children, brothers, sisters, business partners or associates, may enter a promotional competition by Weylandts.
- All participants who enter promotions by Weylandts must be at least eighteen (18) years old at the time of entering the promotion and must reside in South Africa.
- Weylandts reserves the right to vary, postpone, suspend or cancel any promotion or competition, any aspect of the promotion and anything related thereto, without notice at any time and for any reason whatsoever that Weylandts deems is reasonable at the time. Should Weylandts, law or any authority cancel this promotional competition, no notice of cancellation shall be required. In such event, all participants and winners waive any rights and acknowledge that they shall have no claim, of any nature whatsoever against Weylandts, its directors, agents or employees as a result of the cancellation.
14. Loyalty Rewards
- Customers who are members of our Loyalty Rewards Programme may earn points for certain purchases which can be redeemed in store.
- Loyalty points cannot be earned on sale items, mattresses, or service fees.
- Loyalty points cannot be utilised as a means of payment on our website.

15. Disclaimers
- Unless any applicable law prescribes otherwise, any agreement made with Weylandts to buy goods or services, shall be governed by the laws applicable to South Africa.
- Weylandts may, in its sole discretion, change any of these Terms and Conditions at any time. It is your responsibility to regularly check these Terms and Conditions and make sure that you are satisfied with the changes. Should you not be satisfied, you must not place any further orders on, or in any other way use, the website.
- Weylandts does not warrant that any of its goods are fit for a particular purpose, other than that which it is reasonably and generally intended. All goods are to be used as intended only in a domestic environment unless specified otherwise in writing by Weylandts.
- Please be advised that the protections afforded under the CPA do not apply to any transaction in which the customer is a juristic person whose asset value or annual turnover, at the time of the transaction, equals or exceeds the threshold value as determined by the Minister and which is currently R 2 000 000.00 (two million Rand).
- These Terms and Conditions do not affect any rights, remedies or obligations to which a customer is statutorily entitled.

- Should any of our products contain an obvious error regarding the price displayed for the product, Weylandts will correct the error as soon as we have been notified of the error. Weylandts will not be bound by the incorrect price.
- Weylandts may, in its sole discretion, change any of these Terms and Conditions at any time. It is your responsibility to regularly check these Terms and Conditions and make sure that you are satisfied with the changes.
